Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Findalyse ("Findalyse", "we", "us") for the use of our SaaS platform and related services. By creating an account or using Findalyse, you accept these Terms.
1. Applicability
These Terms apply to every agreement between Findalyse and the Customer regarding the Findalyse platform, including any free trial, paid subscription, API access, or related services. Any general terms of the Customer are expressly rejected.
2. Business-to-business only
Findalyse is a business-to-business (B2B) service. The Findalyse platform is intended exclusively for use by professional users — businesses, agencies, consultants, and other organizations acting in the course of their trade, business, craft, or profession.
Findalyse is not offered to consumers. By creating an account, you confirm that you are acting in a professional capacity and that Dutch and EU consumer-protection rules do not apply to our agreement.
3. Description of the service
Findalyse is a SaaS platform for AI visibility analysis. Depending on your subscription tier, the service may include domain scanning, AI visibility scoring across multiple pillars, actionable improvement recommendations, competitor benchmarking, content-gap analysis, branded PDF reports, scheduled monitoring, and related tools. The exact feature set per plan is described on our pricing page and may evolve over time.
4. Accounts
To use Findalyse you must register for an account. You agree to provide accurate and complete information, keep your login credentials confidential, and accept responsibility for all activity under your account. You must promptly notify us of any unauthorized use. Accounts may not be shared outside the seat or team allowance of your plan.
5. Free trial
Findalyse offers a 14-day free trial on all paid plans. A valid payment method is required to start the trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the standard rate of the plan you selected. You may cancel the trial at any time from your billing settings.
6. Subscriptions, pricing and payment
Findalyse is offered on monthly and annual subscription cycles, plus optional per-domain and per-seat add-ons that bill alongside your main subscription. Current prices (excluding VAT where applicable) and plan limits are published on our website. Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period until cancelled.
Annual plans are billed in full at the start of the period and include a 15% discount versus the monthly equivalent. The discount represents your commitment to the full year, which is what lets us offer the lower price. For that reason, annual subscriptions are non-refundable for early cancellation — you keep full access for the entire period you've paid for, and your subscription simply does not renew at the end. Monthly subscriptions can be cancelled at any time and you keep access until the end of the current billing period.
We may change our pricing or plan features from time to time. Changes to your current subscription will take effect at the start of the next billing period, and we will notify you in advance by email or in the application.
If a payment fails, we will retry in line with Stripe's standard dunning process. If payment remains unsuccessful, we may suspend or terminate your access to the service.
7. Cancellation and refunds
You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of your current billing period; you retain full access until that date. As described in section 6, we do not provide pro-rata refunds for unused time within a period — this applies to both monthly and annual cycles, and to any per-domain or per-seat add-ons attached to your subscription. After termination, your account data is retained in line with our Privacy Policy and then deleted or anonymized.
We may suspend or terminate your account immediately in the event of non-payment, material breach of these Terms, misuse of the service, or activity that creates a security or legal risk.
8. Acceptable use
When using Findalyse you agree not to:
- use the service for any unlawful, fraudulent, or harmful purpose;
- scan domains you do not own or have no legitimate reason to analyze;
- infringe the intellectual property, privacy, or other rights of third parties;
- attempt to reverse engineer, decompile, or otherwise extract the source code of Findalyse;
- scrape, replicate, or resell any part of the platform;
- use the service to generate spam, misleading content, or disinformation;
- bypass usage limits, rate limits, or security controls;
- share accounts outside the seats permitted by your subscription plan.
9. Usage limits and fair use
Each plan includes limits on the number of domains, scans, benchmarks, PDF exports, team members, and API usage. These limits are published with each plan. Findalyse reserves the right to apply reasonable rate limits and anti-abuse measures to protect platform availability and to enforce fair use for all customers.
10. Intellectual property
The Findalyse platform, its software, user interface, scoring methodology, brand, logos, and documentation are owned by Findalyse and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable right to use the service for your own business purposes during the term of your subscription.
You retain ownership of any content you upload or connect to the service (including your logo, brand assets, and domains). You grant Findalyse a limited license to process your content solely for the purpose of providing the service.
11. Customer content and reports
You are responsible for ensuring that you have the right to use and analyze any content and domains you submit to Findalyse. Branded PDF reports generated by the service may be used and shared with your own clients as part of your professional activities.
12. AI output and disclaimer
Findalyse uses large language models and third-party data sources (including OpenAI, Anthropic, and SerpAPI) to generate analyses, scores, and recommendations. These outputs are advisory in nature. They are intended as professional tools to support your decision-making, not as legal, financial, SEO, or marketing advice.
We make no guarantee about future AI rankings, mention frequency, search visibility, traffic, conversions, or revenue based on the use of Findalyse. AI models and search platforms change frequently, and results may vary.
13. Service availability and changes
We work hard to keep Findalyse available and reliable, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, security updates, and improvements that temporarily affect availability. We may also add, modify, or remove features from time to time.
14. Liability
To the maximum extent permitted by law, Findalyse's total aggregate liability arising out of or in connection with these Terms or the use of the service is limited to the amount actually paid by the Customer for the service in the 12 months preceding the event giving rise to the claim.
Findalyse is not liable for indirect, consequential, or incidental damages, including but not limited to lost profits, lost revenue, lost business opportunities, loss of reputation, loss of data, or damages resulting from third-party services or AI model outputs.
The limitations in this section do not apply in the case of intent or gross negligence on the part of Findalyse.
15. Indemnification
You agree to indemnify and hold Findalyse harmless against any third-party claims, damages, or costs arising from your use of the service in breach of these Terms, your violation of third-party rights, or content you submit to the service.
16. Confidentiality
Each party agrees to treat as confidential any non-public information it receives from the other party in connection with the service, and to use that information only for the purposes of performing this agreement.
17. Governing law
These Terms and any agreement between you and Findalyse are governed by Dutch law.
18. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows when they were last updated. For material changes we will notify account holders in advance by email or in the application. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
